All Hauz Khaz eateries to adhere to building and ASI norms
During the hearing of a plea of a Hauz Khas eatery that was shut down for being located in a structure of over 15 metre height, violating the rule laid down by the Archaeological Survey of India (ASI), Justice V K Rao observed that building bye-laws and archaeological norms should be applicable to all the eateries and restaurants in the area. The Delhi High Court also directed the local authorities to take strict action against the violators. "If there was a violation of any building bye-laws or permission granted by the ASI, it should be an impediment for everyone to run a restaurant. The respondents cannot close their eyes and allow the illegality to be perpetuated by other restaurants in the same building. The respondents are required to take action in that regard," the court told the authorities including the South Delhi Municipal Corporation, SDMC. The High Court rejected the contention by Moonshine Cafe and Bar, a well-known eatery in the area, which had claimed that it was located on the second floor of the building like other restaurants. "Cannot claim any negative equality," said the court while dismissing the plea and asking SDMC to close the eatery and revoke the license. The corporation had taken the decision as the eatery had been running from a building that was more than 15-meters in height, which is not permitted in the area as per ASI norms. The eatery had challenged the decision by SDMC by which its health trade license and revoked and the restaurant was closed. The corporation had also shared that the eatery was catering to more than 48 people at a time and had no safety clearance and was also operating in unhygienic conditions.
