Bombay High Court agrees to working mom’s plea transfer
Taking a considerate view towards a ‘working mother’, who finds it’s difficult to travel from Kurla to Thane, to attend hearings in a matrimonial case, filed by her estranged husband, the Bombay High court on Monday, transferred the proceedings from the Thane family court to the Bandra family court. Justice Mridula Bhatkar, while hearing the application filed by a woman, seeking transfer of the petition for restitution of conjugal rights filed by the husband, said, “The wife is residing at Kurla and she has sought transfer of the proceeding from Family Court, Thane to Family Court, Bandra. Considering the distance between Kurla and Bandra, and Thane and Bandra, normally this application cannot be considered and I would not have allowed this application. However, it is pointed out that the couple has a two year old baby girl and the applicant is taking care of the baby girl. The applicant is also a working woman. Under such circumstances, I am of the view that the convenience of the mother, who is the applicant, is to be considered and hence, I allow the application.” The court also set aside suggestions given earlier by the court to the Thane family court for considering use of video conferencing to hear the application. Justice Bhatkar relying on a recent apex court order, said that video-conferencing in transfer petitions cannot be directed.
