Bombay High Court allows woman to abort 28-week foetus over fears of trauma to her
In a significant ruling, now courts will have to consider the threat perception and risk to the life of a pregnant woman post delivery while deciding matters of medical termination of pregnancy. This ruling was delivered by the Bombay HC on Tuesday while allowing a 28-weeks pregnant woman to abort her foetus. A division bench of Justice Ravindra Borde and Justice Rajesh Ketkar interpreted a provision of the Medical Termination of Pregnancy (MTP) Act, which dealt with permissions for terminating a pregnancy at an advanced stage. To be precise, section 5 of the Act deals with permitting abortion only when a medical expert suggests for it in order to save the life of a woman. The judges interpreted this provision while deciding the plea of a 28-week pregnant woman, who sought permission to undergo an abortion. She contended that her case be considered under section 5 since there are chances that she can undergo severe physical and mental trauma if compelled to deliver the child.
