Compassionate job not for well-off families

In a significant order, the Bombay High Court has said that the appointment of a government employment on compassionate grounds cannot be given to a family which is not facing a financial crisis. A division bench of Justice S V Gangapurwala and Justice A M Dhavale, while rejecting a petition filed by Seema Kausar who had sought employment as a teacher in a Urdu medium school where her father worked, said "The application deserves to be rejected on the ground of the sound financial position of the family and the petitioner not being an eligible family member for appointment on compassionate grounds." Her application was opposed on the ground that she was married and her husband is gainfully employed. Besides, Kaur also receives monthly pension of Rs 20,000 and her husband gets a huge retirement benefit. Although Seema countered the arguments of the school, saying that the receipt of the family pension cannot be a ground for the disqualification from compassionate employment. The court after going through records and relying on several judgments noted, "The petitioner is a married daughter, whereas the deceased has two sons out of which one is grown up, and thus a married daughter is not eligible for appointment. No reason is given on why she has left her husband and she is staying with her mother. This clearly shows that it is an after thought."
