Delhi High Court allows minor rape survivor to terminate pregnancy after 26 weeks
Allowing the petition of girl's father, the bench of Delhi High Court Justice Yashwant Verma said the pregnancy would permanently scar girl's psyche and cause irreparable injury to her mental health. New Delhi: In a major verdict, the Delhi High Court has allowed a minor rape survivor to medically terminate her pregnancy after 26 weeks and 6 days. Passing the verdict, the court noted that the pregnancy was forced and it would permanently scar teh victim's psyche and cause irreparable injury to her mental health. The Delhi High Court has asked the medical board of Safdarjung Hospital to complete formalities. A bench of Justice Yashwant Verma on Tuesday allowed the petition of victim's father. The court has asked Safdarjung Hospital to form a medical board, according to a report in Hindi daily Hindustan. The victim was asked to appear before the medical board on July 21. The bench ordered the hospital to preserve foetus for DNA purpose which will be required for criminal investigation. The court has also given Safdarjung Hospital an option to abort the process of pregnancy termination if they feel the life of the girl was in danger. In his order, Justice Verma observed, "The court is of the firm opinion that if the petitioner was forced to go through with the pregnancy despite the same having been caused on account of the incident of sexual assault, it would permanently scar her psyche and cause grave and irreparable injury to her mental health. The court cannot visualise a more egregious invasion of her right to life as guaranteed by Article 21 of the Constitution."
