Delhi High Court has directed a private school to allow an unvaccinated teacher to resume his duties. The teacher has been granted an exemption from the COVID-19 vaccine as he is at a “higher risk” for an allergic reaction to it as compared to the general population. Details shared below. Delhi High Court has allowed an unvaccinated teacher to resume his duties. As per the order issued by Delhi HC, the private school where the teacher works has been directed to allow him to join for duty. Justice Rekha Palli, who heard the petition, has granted this exemption under special conditions. With the coming of the COVID-19 pandemic, it has become mandatory to be vaccinated for almost all citizens in order to safeguard themselves from the virus. However, this particular teacher has now been allowed to resume his duties as a teacher and exempted from the COVID-10 vaccine. The teacher was exempted and allowed to join his duties after a medical board found that he was at "higher risk" of having an allergic reaction to the COVID-19 Vaccine. The medical board, which was constituted by five experts from AIIMS stated that the teacher was at greater risk of an allergic reaction as compared to the general population. The exemption comes with special conditions. Justice Rekha Palli has noted the exemption but has ordered the unvaccinated teacher to wear a mask at all times while in the school premises and observe all COVID-19 safety protocols in place. Delhi HC also ordered the school to release the balance salary, after deducting 10 per cent, as well as the allowances payable to the petitioner. The teacher suffered from Angioimmunoblastic T-cell Lymphoma, which is a type of cancer.Due to this, he was advised by doctors to avoid the COVID-19 vaccine as there were chances of his condition deteriorating. The teacher proceeded to file a writ petition with the Delhi High Court after the exemption granted to him was withdrawn in October 2021.
