HC asks Delhi Police to reply within 2 weeks on Sharjeel Imam's plea challenging trial court order

Delhi Police has been granted an extension of 90 days by a trial court after they failed to file a chargesheet in stipulated 90 days. The Delhi High Court has issued a notice to Delhi Police on a petition moved by JNU scholar Sharjeel Imam who has challenged the trial court's order granting three months to cops to file the chargesheet against him under the Unlawful Activities (Prevention) Act. Imam was booked by Delhi police in late January for an alleged inflammatory and instigating speech made during a protest against the Citizenship Amendment Act (CAA) and the National Register of Citizens (NRC). Delhi Police has been asked to file a reply within two weeks. Earlier, Delhi Police failed to file a chargesheet under UAPA within stipulated 90 days. A lower court in Delhi, however, granted the police a 90-day extension to file the charge sheet on the ground made by the investigating agency, that they needed time to investigate the case as they were to invoke UAPA against the accused. He had approached the court for default bail but Additional Session Judge Dharmender Rana dismissed the plea and observed that it was not legally competent to review its own order. Imam then moved the Delhi High Court, challenging the trial court order also sought default bail in the matter. A PhD student at the Jawaharlal Nehru University's Centre for Historical Studies, Imam was booked in sedition cases lodged across several states for alleged "inflammatory" speeches made during anti-CAA protests. Delhi Police's Crime Branch arrested Imam from Jehanabad area in Bihar on January 28 after conducting raids at various places including Mumbai and Patna. Last month, Delhi Police said it was invoking stringent UAPA against Imam.
