Suspended AAP MLA wants L-G, Speaker to ensure CM's presence in House
The Delhi High Court on Monday agreed to hear a plea filed by suspended AAP MLA Kapil Mishra seeking direction to the Lieutenant-Governor (L-G) and Speaker of the Assembly to ensure presence of the Chief Minister in the Assembly and reply to the questions related to public interest.
When the matter was mentioned before a Vacation Bench comprising Justices Sangita Dhingra Sehgal and C. Hari Shankar, it asked the lawyer for Mr. Mishra to file the petition.
The petition filed through Ashwani Kumar Dubey sought for direction to the L-G and the Speaker to take appropriate steps to ensure the presence of all MLAs, including the Ministers and the Chief Minister in the Assembly on at least 75% of the sessions.
No-work-no-pay
The plea also sought to ascertain feasibility of “no-work-no-pay” for the MLAs, if presence is less than 50% in the Assembly.
Mr. Mishra’s petition claimed that the Delhi Assembly had 27 sessions last year but Chief Minister Arvind Kejriwal, who is also the Water Minister, were present in only seven.
“It is not out of context to state that Delhi faces water crisis every year,” Mr. Mishra said.
He alleged that Mr. Kejriwal was also not present in the Special Session, called from June 6 to June 10, 2018, to discuss the full statehood for Delhi.
“He [Mr. Kejriwal] was never present in Assembly during the Question Hour in the last 40 months. This shows how serious the Chief Minister is in discussing matters related to the people of Delhi and their development and performing the duties expected of him,” the petition also said.
The plea demanded that the Chief Minister should bring out an annual report card clearly outlining his performance.
“He needs to inform the people of their constituency and also all the citizens of Delhi, how well he performed against indicators like their attendance in the Assembly, the number of questions that he replied, his understanding and appreciation of the different policies and laws that he made...,” the plea further said.
