SC confirms death for Nirbhaya convict, dismisses review plea
New Delhi: The Supreme Court on Wednesday dismissed the review petition filed by Akshay Kumar Singh, one of the four death row convicts in the 2012 Delhi gang rape and murder case. The apex court has now dismissed all the four review petitions related to the case. The development comes on a day when the apex court took suo motu cognizance to assess the criminal justice system in response to sexual offences. The bench headed by Chief Justice S.A. Bobde said the Nirbhaya case had shocked the nation. Singh had on 10 December filed a plea seeking a review of the 2017 verdict of the Supreme Court, which upheld the capital unishment given to him and three others by the Delhi high court and trial court. “We do not find that these findings suffer from any error apparent on the face of the record. The mitigating circumstances elaborated upon by the defence by way of highlighting the comparatively young age of the convicts, their socioeconomic background, their unblemished antecedents and their chances of reformation fade into insignificance," said the three-judge bench of the apex court headed by Justice R. Bhanumathi. “In light of the aggravating circumstances and considering that the case falls within the category of rarest of rare cases, the death penalty is confirmed," the court said. “None of the grounds raised in the review petition calls for review of the judgment dated 5 May 2017. The review petition is dismissed," it said. On 9 July 2018, the apex court had dismissed the pleas of three convicts, Mukesh, Pawan Kumar Gupta, and Vinay Sharma, who had sought a review of the verdict. On 16 December 2012, a 23-year-old woman was brutally assaulted and raped by six people in a moving bus in south Delhi. The incident prompted nationwide protests. The woman succumbed to injuries on 29 December at Mount Elizabeth Hospital in Singapore. Meanwhile, a Delhi court directed Tihar Jail authorities to issue a fresh notice to the convicts on whether they will file mercy petitions or not. The court will now hear the matter on 7 January.
